TPD claim – $550,000 payout
Jim suffered a psychological injury in 2006 and attempted to claim his Total and Permanent Disablement (“TPD”) benefit through his superannuation. In 2007 our client’s claim was declined, and it was not until 2019 that he came to us to review his claim. At that time, he was outside of the limitation period, meaning that legally he could not commence litigation against the insurer. However, we reviewed a copy of his claim file and decided to fight for Jim and have his decision overturned.
This claim required a significant amount of work and the law in this area is complex. Despite the odds, and even though it was over 10 years since a decision was made, we were successful in having the 2007 decision overturned.
We obtained approximate $250,000 for our client which represented his TPD benefits, plus we made a separate claim for a further extra amount of $300,000 representing interest, bringing his compensation to a total of $550,000.
