Common Questions

What is sexual harassment?

You may have a claim for sexual harassment if you have been subjected to unwelcome sexual conduct by someone else, in ways that a reasonable person would anticipate could offend, humiliate or intimidate you.

Sexual harassment can include:

  • inappropriate advances
  • intrusive questions
  • inappropriate comments
  • staring, touching
  • sexually explicit messages
  • requests for sex or unwanted date requests
  • physical assault
  • indecent exposure
  • stalking

If you, or someone close to you, is experiencing any of these behaviors, it is important that you seek advice for counselling and support.

You can also contact us for legal advice free of charge on 1300 769 665. We have a team of trained lawyers trained to deal sensitively with your situation.

Where can it occur?

Most sexual harassment cases occur in the workplace.

However, sexual harassment can also happen in:

  • schools
  • universities
  • sports teams
  • child care centres
  • church or church run institutions
  • medical service centres
  • public places
  • the Australian Defence Force; or
  • on-line
  • on the phone

Do I have a claim for sexual harassment at work?

Sexual harassment at work is illegal.

Your employer can be held liable for sexual harassment in the workplace unless they can prove that they took all reasonable steps to prevent the sexual harassment from occurring.

There are time limits for making a claim for sexual harassment or abuse, so it is important to get advice as soon as possible. However, even if you think the time limit has passed, still contact us for advice.

What should I do if am being sexually harassed at work?

In addition to seeking legal advice, there are a number of things that you can do.

  1. Keep a diary

Make notes of who, what, when and where the abuse occurs. This will make it easy to remember and help us with your claim if you decide to proceed with seeking compensation.

  1. Don’t wait till it gets worse

Many employees don’t do anything because they don’t want to make a fuss, or they think they can deal with whatever is happening by ignoring it. In some situations, this can lead to the abuse getting worse, and you could suffer a stress related work in injury which stops you working at all.

Addressing the situation early also means that you might protect others in your workplace from experiencing abuse.

  1. Make a complaint

Find out if your employer has any policies in relation to making a complaint (they should) and this will direct you who to contact and how.

A written complaint is best because it is often a less confronting way of bringing a difficult situation to light.

A written complaint is also helpful if you want to make a claim, as it can be used as evidence. When writing your complaint be concise, and try to stick to the key points.

If you need help making a complaint, we would encourage you to get legal advice first, to support and guide you. Our team are always ready to give you sensitive and careful guidance.

  1. Contact your union

Most unions have experience dealing with these situations and supporting you through it.

Also, if there are a number of people in your workplace affected, you might be able to make a claim together. There’s power in numbers.

  1. See your GP

If you are being affected by workplace harassment, it will be affecting your mental and physical health. Go and see your doctor for support and advice on how you can best look after yourself. They can put you in touch with free counsellors dealing specifically with these situations.
