Learn moreAfter a laparoscopic procedure to remove her ovaries and fallopian tubes, Amy* suffered a perforated bowel, leaving her unable to walk or work. We proved that the hospital’s failure to take precautions and monitor Amy during surgery caused her condition.
Before the procedure, the hospital informed Amy that it carried a risk of bowel perforation. She acknowledged the risk and went ahead with the surgery. Unfortunately, her bowel was perforated during the procedure, leading to follow-up surgeries. Amy was left wheelchair-bound, psychologically traumatised, and with permanent bowel function impairment. She requires daily care and cannot return to work.
When Amy came to us, we immediately suspected she had a claim despite the hospital informing her of the procedure’s risks. Our national network of medical experts assessed the hospital’s actions and Amy’s condition. They determined that the hospital had failed to take appropriate precautions during surgery to minimise the risk of bowel perforation. Additionally, they failed to detect the perforation during the procedure.
Armed with this evidence, we filed a claim against the hospital in the Supreme Court of Melbourne. The hospital denied responsibility for Amy’s injuries, so we brought in further experts to assess her condition. Ultimately, Amy was awarded $2.5 million in an out-of-court settlement, along with part of her legal fees.
