Learn morePeter’s job took a serious toll on his body. He injured his left shoulder so severely that he needed arthroscopic decompression surgery. During his recovery, he relied too much on his right shoulder, eventually injuring his left shoulder, too.
Given the extent of Peter’s injuries, we knew he was eligible for more than just weekly payments and medical expenses — he could receive a substantial lump sum payment for permanent impairment.
Before we could move forward, Peter’s injuries needed to stabilise. This means they had reached Maximum Medical Improvement (MMI) and were unlikely to improve further with treatment. Once this happened, we arranged for Peter to have his Whole Person Impairment (WPI) assessed.
During the assessment, Peter shared that he was dealing with sleep issues and significant weight gain related to his injuries. We recommended a sleep study, which confirmed he had sleep apnea.
Armed with this expert evidence, we were able to have both Peter’s shoulder injuries and his sleep apnoea included in his WPI assessment. He was given a 35% WPI and, off the back of this assessment, we successfully secured him a $112,010 settlement.
Because Peter’s WPI exceeded 30%, he’s now classified as a worker with the highest needs. This means he’s entitled to weekly payments from the insurer until one year after retirement age, lifelong medical expense coverage, and he no longer has to go through constant work capacity assessments.
