During a routine implant removal, Sarah’s doctor was unable to locate the contraceptive. Their persistence with the surgery caused debilitating nerve injury and pain. We consulted with an experienced GP who prepared a comprehensive report on the mistakes made during the surgery. They confirmed that Sarah’s family doctor should have stopped the procedure and referred Sarah to a specialist or another doctor with the experience to carry out the procedure. We also had Sarah assessed by an occupational therapist and a rehabilitation specialist to document her disabilities.
Proceedings were commenced in the Supreme Court of NSW. The insurance company eventually admitted liability on behalf of the family doctor. The matter was then referred to mediation where it was settled for $750,000.00.
