What is silicosis?

Silicosis is a lung disease caused by exposure to silica dust. This dust is produced during mechanical processes like crushing, cutting, drilling, grinding, sawing, or polishing products containing silica. Once inhaled, silica dust can reach deep into the lungs, causing irreversible damage.

Unlike asbestos-related diseases, which can take decades to manifest, silicosis can develop as early as one year after exposure — though it’s typically diagnosed around ten years later.

Symptoms of silicosis

The symptoms of silicosis vary depending on the timing and severity of your exposure.

In the early stages of silicosis, you may only experience mild symptoms such as shortness of breath, a cough, or a build-up of phlegm. In some cases, you may not experience any symptoms at all. This stage is known as ‘simple silicosis.’ If your exposure is minimal, your condition may not worsen beyond this stage.

However, if you had heavy or long-term exposure to silica, you may develop ‘accelerated silicosis,’ or progressive massive fibrosis. Both illnesses are severe and can cause:

  • Difficulty breathing
  • Severe shortness of breath
  • Persistent cough
  • Leg swelling
  • Night sweats
  • Fever

What types of claims can I make?

There are two primary types of silicosis claims: ‘statutory claims’ and ‘common law damages claims’. Depending on your situation, you may be eligible for both.

Statutory compensation claims

If you were exposed to silica dust at work, you may qualify for a statutory compensation claim.

Each state in Australia has its own compensation scheme for silicosis and other dust diseases. For instance, in Victoria and Queensland, you typically lodge a silicosis claim through the regular workers compensation scheme. However, in states like NSW, you must apply through a specialised dust diseases body.

An exception to this rule applies if you were employed by the Commonwealth or certain private companies (e.g., Telstra or Australia Post) during your exposure. In these instances, you may have a claim under the Comcare scheme instead.

How much compensation can I get?

All workers with silicosis are entitled to weekly payments to cover:

How to make a common law damages claim

In Western Australia, meeting a minimum percentage of impairment may also be necessary before pursuing a silicosis claim.

How much compensation will I receive?

You will receive lump sum compensation to cover various costs related to your silicosis, including:

  • Pain and suffering (the impact of your condition on your life).
  • Loss of life expectancy.
  • Loss of ability to care for dependents (e.g. children or a spouse).

Frequently asked questions

You may be eligible for multiple claims, depending on your state, the specific type of condition, and your work capacity.
