To claim Death Benefits, the person who passed away should have been part of a superannuation fund or had death benefit insurance. If they are terminally ill and expected to pass within the next 24 months, you might also be able to make a terminal illness claim.

You will need to contact your loved one or family member’s superannuation fund and/or Death Benefit insurer to determine whether there are potential benefits to claim. Unfortunately, if you do not know the details of their fund, it can be difficult to access this information. Below, we have outlined a number of possible avenues to finding this information.

  1. The first option is to contact their last employer and ask which fund their superannuation was being paid into.
  2. Alternatively, if you do not know the fund details and the employer will not confirm them, you can attempt to perform a super search through the Australian Taxation Office (“ATO”). An ATO search requires a court order from the Supreme Court, allowing you to access that information. This is known as Letters of Administration or a Grant of Probate. In our experience, without these documents, it is unlikely that the ATO will release any information.
  3. As another alternative, if you have legal access to their mail or email, you can check for any recent statements from superannuation funds or Death Benefit insurers.
