Winning Your TPD Claim Against Big Insurers

Warren Bennett is a lawyer at Monaco Solicitors who handles total permanent disablement (TPD) claims. He explains that clients usually seek help for two reasons: either they can’t work anymore because of injury or illness, or they’ve tried to handle their claims themselves but were denied due to technicalities or insurer assessments. Warren finds it rewarding to fight for these clients, especially since many denials seem unfair.

He understands that legal fees can be intimidating, so his firm offers free consultations and operates on a No Win No Fee basis. Their lawyers know the ins and outs of the law and create submissions that really fit what each client needs. Warren feels a great sense of achievement when he wins a case, helping clients who are struggling financially to pay for their living expenses and support their families.

Winning Your TPD Claim Against Big Insurers

Hi, my name's Warren Bennett. At Monaco Solicitors, I'm the total permanent disablement lawyer of the firm. In my field of total permanent disablement insurance, there's two types of inquiries that we do receive. The first inquiry is of a client that has stopped work because of either injury or illness, and unfortunately, they cannot work anymore. Therefore, the first type of inquiry is they come to a lawyer with expertise in superannuation claims to help them through the complexity and the web of insurance claims. The other part TPD insurance is when clients have actually self-represented themselves and they've made a claim themselves, and unfortunately, maybe on a technicality of the policy definition or where the insurer has actually got a sum report to say that the client can actually work 20 hours per week in a different field than what they were educated, trained, and experienced in. They often then come to us for advice to see whether or not they have a chance of fighting the big insurers in terms of getting a successful outcome. In my lengthy experience in life insurance as a lawyer, I have found that a lot of these cases that have been declined are unfair and unjust. Relying on medical evidence that the insurer has obtained, or relying on a technicality within the policy, in my eyes, is unfair. And my job is, which I get great satisfaction on, is to win the client's claim and to argue the particular case and get a great outcome. When people feel that they may need the help of a lawyer, I understand that a lot of people are sometimes very afraid or intimidated or can't think of the paying $400 or something like that for a consultation fee. At Monaco Solicitors, we offer a free consultation and also a free review of your case. The benefits of actually using a lawyer to represent you in your TPD claim is that the lawyers know the law, the lawyers know the superannuation law, the case law, and also the policy documentation. The good thing about us is that we actually do a tailored submission that suits your needs in terms of relevancy in your claim. What I find is when clients actually achieve a successful outcome, they comment to me one thing, I wish I used a lawyer sooner. The satisfaction I get from helping out any client that we have in a successful outcome is that we fought the big insurer. We're the little guy, we fought the big insurer, so we feel a sense of, and I feel a sense of, overwhelming satisfaction that I've actually helped the client be successful because they can't work anymore. They've got no funds coming in, and obviously when they do come to us, they've got maybe a mortgage, they've got kids to feed, they've got other overwhelming expenses. So when I do achieve a successful outcome, it gives me great sense that it can help at least to pay some of these expenses and help them live a life that they should deserve to live.
