Our Medical Negligence team commenced proceedings in the Supreme Court of NSW. We investigated and found that both the midwife and other hospital staff present had failed in their duty of care. They had taken no x-rays before the birth, and the difficult labour went on for too long without medical intervention. The hospital staff also ignored signs of foetal distress.
A child psychiatrist then examined Nadia to determine her present and future needs. Due to Nadia’s age, they were unable to make a definitive assessment. Court proceedings paused temporarily.
Nadia was re-examined a year later by the same child psychiatrist. They provided a comprehensive report detailing her future needs and limitations. Court proceedings were then ‘unfrozen’. We successfully settled Nadia’s claim for $2.5 million plus payment of her legal costs.
