After the fall, Paul required an urgent hip replacement. He had undergone hip surgery only weeks before the accident, and this new injury left him unable to walk without assistance. Paul was devastated when his surgeon said he would never work again. As a result of his injuries, Paul developed a psychological disorder.
Our leading safety expert inspected the car park and reported serious construction defects. We then subpoenaed documents from Coles and discovered that the company was aware of these defects before Paul’s accident.
At the same time, we engaged an orthopaedic surgeon and a psychiatrist to assess Paul’s physical and mental condition. They confirmed that Paul’s injuries severely impacted his earning capacity and required ongoing treatment.
As expected, Coles refused to acknowledge any wrongdoing and staunchly defended Paul’s claim. Using expert evidence, we proved that Coles’ carelessness destroyed Paul’s quality of life and ability to support his family. The case eventually went to trial in the Supreme Court and the judge ruled in Paul’s favour. But Coles wouldn’t be deterred—they immediately appealed the decision.
We defended the appeal with the help of a respected senior barrister. The Court again found Coles negligent. In the end, Paul was awarded $800,000 in compensation. We also secured an additional $300,000 to cover both our legal fees and the barrister’s fees. As a result, Paul kept all of his hard-won compensation.
