In either case, the ‘egg-shell skull rule’ applies. This rule means that your employer is responsible for the full extent of your injury, loss, and damage, even if a reasonable person might not have experienced such severe harm from the same situation.

To prove negligence in a psychological injury claim, you must establish four key elements:

  1. A duty of care existed: you must demonstrate that the responsible party owed you a duty of care. This means they had a legal obligation to ensure your safety and well-being.
