Frequently Asked Questions

What is income protection insurance?

Simply, income protection insurance gives you an income when you can’t work due to illness or injury.

You don’t have to prove:

  • someone was at fault.
  • you’re unfit for all work, just temporarily unable to do work that fits your level of skill and expertise. So, for example, if you have only ever done manual labour, you can get income support even if doctors think you’re fit enough to do a job in an office.

Do you offer free consultations?

Yes. There’s no cost for our team to investigate your policies and find out you what you’re entitled to. There’s also no-obligation to go any further with us.

Do you offer No Win No Fee agreements?

Yes. We believe everyone is entitled to legal representation no matter what your financial situation, so we offer a free initial consultation and a No Win No Fee guarantee. No Win No Fee means you don’t have to pay any legal costs unless your case is successful.

And, unlike most other law firms, with us there is:

  • A fixed fee on all superannuation and insurance claims.
  • No upfront charge for any expenses.
  • You don’t pay anything if we’re not successful.

How do I find out if I have income protection?

Finding out if you have income protection is the first step in lodging a claim. Check with your super fund what income protection cover you have with them. If you have a private life insurance policy, look in your policy schedule to confirm your cover.

Our lawyers are experts at this so contact us for a free consultation, and we will be happy to find what cover you have.

How long does it take?

You might have to wait from between 2 weeks to 3 months for your payments to start. So, the sooner you start a claim, the sooner you will start getting paid.

You should act quickly when lodging a claim as time limits might apply to your policy.

What happens if my claim is rejected?

We often see clients whose insurer has refused to pay their income protection claim. Sometimes the insurer finds a doctor who says you’re able to work. In other cases, the insurer tries your cancel policy, saying that there was non-disclosure, or insurance fraud. Sometimes the insurer says the condition is a pre-existing condition.

As specialists in this field, with lawyers can often overcome these problems and get our clients paid, either by lodging a dispute with the insurer directly, or by taking the case to Court.

Do I need a lawyer to make an income protection claim?

It’s in your best interest to get a legal expert to navigate this tricky area. Super funds and insurers make it difficult for self-represented claimants to get the benefits they’re entitled to. Sometimes they practice delaying tactics. They may also reject your claim on unfounded reasons. If you have one of our expert lawyers representing you, we can cut through all this and get you the entitlements that you deserve. Our lawyers will make sure that:

  • You’re aware of all your potential disability benefits
  • You maximise your claim
  • You don’t have the stress of dealing with large institutions. If we run the claim for you, we deal with the doctors, ATO, Centrelink and your workers comp insurer on your behalf
