With over 20 years of successful Income Protection Claims,
MCL delivers real results

If you can’t perform your normal work duties for a limited period of time, some superannuation funds have weekly or monthly payments to act as a wage replacement. These are called total and temporary disability (TTD) benefits, salary continuance or income protection payments.

Most superannuation funds have income protection but many Australians don’t know they are covered. Typically, payments can be up to 75% of your wage plus super.

At MCL we have an experienced team of lawyers specialising in income protection. We can advise you of all your potential disability benefits, and maximise your claim to entitlements.

Frequently Asked Questions

How do I make a claim?

The first thing is to find out how much income protection cover you have. If you are temporarily unable to work because of injury or illness, contact us and our Income Protection team can find what your entitlements are, obligation free.

We can then run the claim for you, including dealing with insurer, doctors, tax office, Centrelink, and your workers’ compensation insurer. We act on a No Win No Fee basis for income protection claims, which means that we only get paid if you do and there are no up-front costs.

You should act quickly when lodging a claim, as time limits may apply.

What else do I need to know?

You don’t have to prove someone was at fault to claim TTD, just that you are temporarily unfit to work in your normal job.

You don’t have to be unfit for all work, just temporarily unable to do work that fits your level of skill and expertise. So, for example, if you have only ever done manual work, you could get a TTD insurance benefit even if doctors think you’re fit enough to do a job in an office.

How long does it take?

Claims take from 4 weeks and up to be accepted. It’s not uncommon for payments to go through a qualifying period of 1 – 3 months, so it can take a while before your payments actually start.

The good news is, once we do get your payments rolling, your income protection payment will come in regularly. This is usually monthly, but it can be weekly.

Income protection will be paid to you for a set period of time, usually 2 years, 5 years, up until age 65.

How much am I entitled to?

The payment is usually around 75% of your income, plus super.  If you are able to return to work on a part-time basis, or in a lower paid job, then some income protection insurance policies will top up your wages.

What if my insurer refuses to pay?

We often see clients whose insurer has refused to pay their income protection claim. Sometimes the insurer finds a doctor who says the person is able to work. In other cases, the insurer tries the cancel policy, saying that there was non-disclosure, or insurance fraud. Sometimes the insurer says the condition is a pre-existing condition.

As specialists in this field, with lawyers who also have experience working with insurance companies, very often we can overcome these problems and get our clients paid, either by lodging a dispute with the insurer directly, or by taking the case to Court.
